By accessing or using lttr.io ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

lttr.io is a platform that connects newsletter writers to facilitate recommendation swaps. We provide tools for matching, communication, and tracking swap results. We do not guarantee any specific results from using our Service.

3. Eligibility

To use lttr.io, you must:

• Be at least 18 years old
• Have a valid Substack newsletter
• Provide accurate and truthful information
• Have the authority to enter into these Terms

4. Account Registration

When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

5. User Conduct

You agree NOT to:

• Provide false or misleading information about your newsletter
• Misrepresent your subscriber count or engagement metrics
• Spam or harass other users
• Use the Service for any illegal or unauthorized purpose
• Attempt to manipulate the matching algorithm
• Create multiple accounts to circumvent limits
• Scrape, harvest, or collect user data
• Interfere with or disrupt the Service
• Violate any applicable laws or regulations

6. Swap Agreements

When you agree to a recommendation swap with another user:

• You are entering into an agreement directly with that user, not with lttr.io
• You are responsible for fulfilling your swap commitments
• lttr.io is not liable for disputes between users
• We may track reliability and share this information with other users

7. Subscription and Payments

7.1 Free Tier

The free tier includes limited features as described on our pricing page. We reserve the right to modify free tier limits at any time.

7.2 Paid Subscriptions

Paid subscriptions are processed through Gumroad. By subscribing, you agree to Gumroad's terms of service. Subscriptions automatically renew unless canceled before the renewal date.

7.3 Refunds

Refund requests are handled on a case-by-case basis. Contact us within 14 days of purchase for refund consideration.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by lttr.io and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of content you submit to the Service but grant us a non-exclusive license to use, display, and distribute it in connection with the Service.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT GUARANTEE ANY SPECIFIC RESULTS FROM USING THE SERVICE, INCLUDING BUT NOT LIMITED TO SUBSCRIBER GROWTH OR SUCCESSFUL SWAPS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, lttr.io SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless lttr.io and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us.

Upon termination, your right to use the Service immediately ceases. Provisions that by their nature should survive termination will remain in effect.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
